2.00 Rights and Limits
Jobbook grants you a revocable, nonexclusive limited license to use its Services solely for your own personal use and not for republication, distribution, assignment, sublience, sale, commercial use, preparation of derivvative works, or any other use.
2.2 Service Availability
Jobbook may change or discontinue any of its Services. Jobbook can't promise to store or keep showing any information and content you've posted.
Jobbook may change, suspend or end any Service, or change and modify prices prospectively at its discretion. To the extent allowed under law, these changes may be effective upon notice provided to you.
Jobbook is not a storage service. You agree that Jobbook have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law.
Jobbook reserves the right to limit your use of the Services, including the number of your connections and your ability to contact other Members. Jobbook reserves the right to restrict, suspend, or terminate your account if Jobbook believes that you may be in breach of this agreement or law or are misusing the Services.
3.1 Service Eligibility
This Jobbook platform is not intended for users under 18 years of age. If you are under 18, you are not authorized to use our Services. You may only create and maintain one Jobbook online profile, which must be under your true identity.
3.2 Personal online profile
By using a Jobbook online profile, you agree to try to choose a strong and secure password, to keep your password secure and confidential and respect the present agreement and the law. You are responsible for anything that happens through your account unless you close it or report misuse.
3.3 Notices and Service Messages
You agree to us using our website, mobile apps and email to provide you with important notices. This Agreement applies to mobile applications as well.
4.00 Exclusion of Liability
Jobbook’s liability to you for damages resulting or arising from or relating to the Services shall not, under any circumstances, exceed the total amount of fees received by Jobbook during the 12 months prior to the date the cause of action arose.
Neither party shall be liable to the other party, any of its customers, affiliates or any other persons for any indirect, special, punitive, incidental or consequential damages or losses (including, without limitation, damages for loss of business, loss of profits, loss of data or the like), whether based on breach of contract, tort, product liability or otherwise, even if a party or its representatives have been advised of the possibility of such damages or if such damages could have been reasonably foreseen.
Jobbook or You may terminate this Agreement at any time with notice to the other. On termination, you lose the right to access or use the Services.
6.00 Dispute Resolution
In the unlikely event we end up in a legal dispute, it will take place in Montreal courts, applying laws of the Province of Quebec. You agree that the laws of the Province of Quebec, excluding its conflict of laws rules, shall exclusively govern any dispute relating to this Agreement and/or the Services. We both agree that all of these claims can only be litigated in the federal or state courts of Montreal, Quebec, Canada, and we each agree to personal jurisdiction in those courts.
7.00 General Dispositions
1. Complete Agreement
The parties acknowledge that this Agreement and its associated annexes constitute a full, faithful and complete reproduction of the Agreement they entered into with each other and replace any earlier Agreement or any commitment to the same effect, whether verbal or written.
2. Severability of Provisions
In the event that any provision in this Agreement is determined to be legally invalid or unenforceable by any court of competent jurisdiction, and cannot be modified to be enforceable, the affected provision shall be stricken from the Agreement, and the remaining terms of the Agreement and its enforceability shall remain unaffected.
8.00 Complaints Regarding Content
We respect the intellectual property rights of others. We require that information posted by Members be accurate and not in violation of the intellectual property rights or other rights of third parties. We provide a special process for complaints concerning content posted by our Members.
